Terms of Service
These terms set out the rules for using Volugraph — our platform for processing, storing, and editing 3D Gaussian captures on web and mobile. By using the service, you agree to them.
1. Who We Are
Volugraph is operated by Volugraph Ltd., a company registered in England and Wales, with its registered office at 71-75 Shelton St, London WC2H 9JQ, United Kingdom (“Volugraph”, “we”, “us”, or “our”). We operate the platform available at volugraph.com and the associated mobile applications (collectively, the “Service”).
2. Acceptance of Terms
By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and references to “you” include that organisation.
3. Description of Service
Volugraph is a mobile and web platform that enables users to upload, process, store, and edit 3D Gaussian captures. Features include but are not limited to:
- Uploading and processing raw Gaussian 3D data into viewable 3D scenes.
- Cloud storage of processed captures.
- In-browser and in-app editing and transformation tools.
- Sharing and exporting of captures.
The Service may be updated, extended, or modified over time. We reserve the right to add, change, or remove features at our discretion.
4. Eligibility and Accounts
You must be at least 16 years old to create an account and use the Service. By registering, you confirm that you meet this age requirement.
You are responsible for providing accurate and up-to-date registration information and for keeping your account credentials confidential. You must not share your login details with any third party. You are solely responsible for all activity that occurs under your account, whether or not you authorised it.
You must notify us immediately at support@volugraph.com if you become aware of any unauthorised use of your account.
5. User Content and Intellectual Property
Your Content
You retain full ownership of all Gaussian 3D capture data, files, and other materials you upload or create through the Service (“User Content”). These Terms do not transfer any intellectual property rights from you to Volugraph.
By uploading User Content to the Service, you grant Volugraph a limited, non-exclusive, royalty-free, worldwide licence to store, process, reproduce, and transmit your User Content solely as necessary to provide and improve the Service on your behalf. This licence ends when you delete your User Content or close your account, subject to any retention periods required by law.
You represent and warrant that you own or have the necessary rights to upload your User Content, and that doing so does not infringe any third-party intellectual property, privacy, or other rights.
Volugraph’s Intellectual Property
All software, algorithms, designs, trademarks, and other materials forming the Service (excluding User Content) are the exclusive property of Volugraph Ltd. or its licensors. Nothing in these Terms grants you any right to use Volugraph’s name, logo, or branding without prior written permission.
6. Acceptable Use
You agree that you will not use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Upload content that infringes the intellectual property, privacy, or other rights of any third party.
- Upload or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the Service, our servers, or systems connected to the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service.
- Use automated tools, bots, or scrapers to access the Service in a way that places unreasonable load on our infrastructure.
- Resell, sublicence, or commercially exploit the Service without our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We reserve the right to investigate suspected violations and to suspend or terminate accounts engaged in prohibited conduct.
7. Subscriptions and Billing
Certain features of the Service are available on a paid subscription basis. By selecting a paid plan, you agree to pay the applicable fees as described at the time of purchase.
- Billing cycle: Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you choose.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Payment processing: Payments are processed by a third-party provider (Stripe). By subscribing, you also agree to Stripe’s terms of service. We do not store your full payment card details.
- Price changes: We may change subscription prices at any time. We will give you at least 30 days’ notice of any price increase before it takes effect. Continued use of the Service after the new price takes effect constitutes your acceptance of the new pricing.
- Taxes: Prices displayed are exclusive of any applicable taxes (such as VAT) unless stated otherwise. You are responsible for any taxes applicable to your purchase.
8. Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us at support@volugraph.com. Cancellation takes effect at the end of your current billing period; you will continue to have access to paid features until that date.
Refunds: We do not offer refunds for partial billing periods. Fees already charged are non-refundable except where required by applicable law.
Statutory cooling-off right: If you are a consumer based in the United Kingdom or European Union, you have a 14-day right of withdrawal from the date of your initial subscription purchase, provided you have not begun using the paid features. If you request and use the Service within the 14-day period, you acknowledge that you expressly consent to the immediate provision of the Service and that you lose your right of withdrawal upon commencement of use.
9. Service Availability
We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. We may suspend or restrict the Service at any time for maintenance, security, or other operational reasons. Where possible, we will give advance notice of planned downtime.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) permanently or temporarily, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
10. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without any warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will meet your requirements, that results obtained through the Service will be accurate or reliable, or that any errors will be corrected.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Volugraph Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to Volugraph in the twelve months preceding the event giving rise to the claim, or (b) £100 GBP.
12. Indemnification
You agree to indemnify, defend, and hold harmless Volugraph Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
13. Termination
You may close your account at any time by contacting us at support@volugraph.com. Upon closure, we will delete your User Content within a reasonable timeframe, subject to any legal retention obligations.
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that we reasonably consider to be harmful to other users, third parties, or our business interests.
Upon termination, all licences granted to you under these Terms will cease. Sections that by their nature should survive termination (including User Content ownership, Limitation of Liability, Indemnification, and Governing Law) shall survive.
14. Governing Law and Disputes
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, except that if you are a consumer resident in another part of the United Kingdom or in the European Union, you may also bring proceedings in the courts of that jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or via a prominent notice within the Service before the new Terms take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
If you do not agree to the updated Terms, you must stop using the Service and may close your account before the changes take effect.
